Only Congress can eliminate federal agencies through legislation

To: Rep. Kiley, Sen. Schiff, Sen. Padilla

From: A constituent in Lincoln, CA

March 6

The President does not have the constitutional authority to abolish the Department of Education through an executive order. Only Congress can eliminate federal agencies through legislation. Attempting to bypass Congress and unilaterally abolish the Department would be an unconstitutional overreach of executive power. I urge maintaining our system of checks and balances and respecting the separation of powers enshrined in the Constitution. The proposed action undermines democratic norms and should be firmly opposed.
