Responsible implementation of Michigan's extreme risk protection law prevents tragedies.

To: Rep. Posthumus, Sen. Outman, Gov. Whitmer

From: A constituent in Rockford, MI

March 8

The new data on Michigan's extreme risk protection law, also known as the "red flag" law, shows that it is effectively addressing dangerous situations before harm occurs. In the first year since its implementation, 287 gun confiscation orders were issued, indicating that firearms were removed from individuals who posed a risk to themselves or others. Significantly, over 11% of those subject to these orders were charged with criminal offenses within a month, including domestic violence and assaulting police officers. This suggests the law is identifying true threats and potentially preventing tragic incidents. While some orders were denied or later rescinded after hearings, the majority were upheld by judges. The law has robust due process protections, allowing individuals to contest orders and have their firearms returned if the risk has passed. However, the data reveals this valuable tool is being judiciously applied to keep guns away from those in crisis. With its safeguards in place, this law is saving lives by giving law enforcement and loved ones a legal avenue to temporarily separate firearms from individuals experiencing mental health crises or engaging in threatening behavior. Continuing this proactive approach to gun violence prevention is crucial for public safety in our communities. The responsible implementation of this law should be supported to uphold its lifesaving potential.
