As evidenced by President Trump's own remarks, there is a clear risk the law could be weaponized to silence critics and remove content that is merely unflattering or critical, rather than actually illegal. The 48-hour removal window and absence of penalties for spurious claims virtually guarantees websites will cave to any takedown demand, no matter how baseless. Automated filters triggered by these demands are also likely to over-censor lawful material. Instead of rushing through this flawed bill, Congress should focus on bolstering existing laws and improving procedures to properly address non-consensual intimate imagery in a manner that protects both victims and free speech. An unbounded censorship system like the one proposed benefits no one except those seeking to escape public scrutiny and accountability. I urge you to vote against the "Take It Down" Act and any legislation that opens the door to viewpoint-based censorship by powerful interests at the expense of Americans' Constitutional rights.
