The bill forces online platforms to remove any flagged content within 48 hours, regardless of whether it is actually non-consensual intimate imagery (NCII), creating an unaccountable censorship system ripe for abuse. This could lead to the suppression of lawful speech by journalists, artists, and ordinary internet users. Furthermore, the legislation endangers encryption by potentially compelling services to weaken security measures and monitor private communications, undermining the very privacy it claims to uphold for victims. Robust laws already exist to combat the non-consensual sharing of intimate imagery. Rather than instituting an overly broad and easily exploited censorship regime, Congress should prioritize enforcing and strengthening current protections for victims. Rejecting this flawed bill would safeguard both free expression and digital security while still allowing for effective recourse against NCII. I strongly encourage you to vote against the TAKE IT DOWN Act and instead pursue balanced policies that defend victims without compromising fundamental rights.
