Defending the Constitution: Preserving Judicial Independence Individual Liberty

To: Pres. Trump, Rep. Bentz, Sen. Merkley, Sen. Wyden

From: A constituent in Medford, OR

March 31

I am writing to express deep concern over the growing threats to the foundational principles of our republic—principles enshrined in the U.S. Constitution to safeguard individual liberty. The most essential safeguard of our freedoms is the system of checks and balances, designed to restrain government power and protect the rights of every individual. Today, this system is under attack. The expansion of the Unitary Executive Theory—the belief that the president holds near-unchecked power over the executive branch—represents a direct challenge to the separation of powers. When executive orders restructure agencies without congressional oversight, when independent institutions face political interference, and when judges are threatened with impeachment for ruling in accordance with the law, the balance of power is dangerously eroded. These actions are not the actions of a government bound by Constitutional law but of one seeking to rule outside of it. An independent judiciary is not a bureaucratic formality—it is a fundamental pillar of a free society. It exists to ensure that laws are applied objectively, free from political coercion or executive influence. When the judiciary is pressured, intimidated, or subjected to retaliatory measures for upholding the Constitution, the rule of law itself is undermined. A judiciary that bows to political pressure ceases to be a safeguard of individual rights and instead becomes an instrument of authoritarianism. The same is true of our system of free speech. The First Amendment was not established as a privilege but as a fundamental right—one that allows individuals to speak freely, challenge authority, and expose corruption without fear of government suppression. The moment a government moves to silence opposition or control the flow of information, it ceases to function as a protector of liberty and instead becomes its greatest threat. The U.S. Constitution is not an obstacle to power; it is the framework that ensures no government, no administration, and no individual stands above the law. It was designed to prevent the very kind of consolidation of authority we are witnessing today. Those who cherish liberty—regardless of political ideology—must recognize that allowing any branch of government to amass unchecked power undermines the freedoms that define our nation. The preservation of individual liberty demands that we stand firm in defense of the Constitution. I urge you to take decisive action to restore the balance of power, protect judicial independence, and reaffirm the principles that prevent tyranny. If these principles are abandoned in the name of political expediency, the consequences will not be temporary—they will reshape the very fabric of our republic. Now is the time to act. The Constitution is only as strong as our willingness to uphold it.
