Denying individuals the ability to obtain accurate identification that aligns with their gender identity perpetuates discrimination and marginalization. Trans erasure bills like HB2438 that mandate gender markers based solely on sex assigned at birth or impose burdensome requirements like surgery disregard the fundamental human rights and dignity of transgender and non-binary people. Such legislation creates unnecessary barriers, increases vulnerability to harassment and violence, and impedes full participation in society. Recognizing one's authentic self through proper documentation is a basic necessity that should not be restricted by the government. A compassionate and inclusive approach is needed to uphold equal protection and respect for all citizens, regardless of gender identity or expression.
