Nationwide injunctions must be an option to impede the current administration's policies. Such injunctions serve an important role in our system of checks and balances by allowing the judiciary to review the legality and constitutionality of executive actions. While the rise of nationwide injunctions is a complex issue, seeking to restrict judicial authority through the appropriations process raises concerning separation of powers implications. Instead, I would urge a more measured approach that respects the role of the courts while addressing specific concerns through the normal legislative process after careful study and debate. We must be cautious about any efforts that could undermine the independence of the judiciary or its ability to serve as a check on the other branches of government.
