Subject: Opposition to the Invocation of the Alien Enemies Act Regarding Tren De Aragua
Dear Representative,
I am writing to express my concern regarding President Trump’s executive order invoking the Alien Enemies Act to address the alleged invasion by the Venezuelan gang, Tren de Aragua. This law, enacted in 1798, grants the President the authority to detain and deport non-citizens from hostile nations during declared wars. Since the U.S. is not at war with Venezuela, using this law against a non-state actor is legally questionable and risks expanding executive power beyond constitutional limits.
The order allows for the apprehension and removal of Venezuelan nationals aged 14 and older based solely on gang affiliation, undermining due process and potentially leading to wrongful detentions without proper evidence.
Furthermore, the reported presence of Tren de Aragua may be inflated, leading to fear-based policies that unjustly target immigrant communities and promote xenophobia. This order is already facing legal challenges, signaling a potential overreach.
I urge Congress to reassess the use of the Alien Enemies Act, support law enforcement through existing legal channels, and promote community trust to address criminal organizations without compromising civil liberties.
